Summary from GAP: According to the advocacy group Taxpayers Against Fraud, the drug industry is the foremost source of Department of Justice settlements pertaining to fraud. Pharmaceutical companies comprised eight of the top ten fraud-related cases in this past year alone, paying the government a collective $3.1 billion under the False Claims Act.

Most of the cases relate to ‘off-label marketing’ — advertising medications for uses not approved by the FDA. Even with an increase in prosecutions and payouts, some public health advocates say harsher penalties are needed to curb illegal marketing.
